EAA: who is concerned, and who is exempt?

Services explicitly covered

• Consumer-facing e-commerce.
• Consumer banking services.
• Electronic communication services (telecoms).

Businesses outside the European Union

The decisive criterion is not where your headquarters are, but your market. If you sell digital products or services to consumers in the Union, you are concerned, even if based outside the EU.

The microenterprise exemption

Microenterprises providing services may benefit from an exemption. The threshold is narrow: fewer than 10 people and an annual turnover or balance sheet below a defined ceiling. This exemption targets services, and its precise application depends on national transposition.
